AGREEMENT TO HOST MONITORING INFORMATION
It is agreed to host monitoring information of our project subject to the following terms and conditions by the following entities :
  • M/s.IPFM Consultancy Services P Ltd., having office at 36, I Floor, Ganesh Temple Cross, Hosur Road, Madiwala, Bangalore 560 068 (hereinafter called as IPFM) and
  • the Registered User, who has registered via online registration form accessed from IPFM web portal and provided with a user name and password to upload monitoring information( hereinafter called as Registered User),
Terms and Conditions:
  • The Registered User read, understood and agree to the terms and conditions including changes therein duly communicated by posting in the Monitoring Organiser portal from time to time.
  • Accessing the IPFM web portal using the assigned user name and password tantamount to acceptance of the terms and conditions.
  • IPFM shall not be responsible for accuracy and veracity of any and all such information provided by the Registered User. It is in good faith the information has been hosted on IPFM . IPFM shall not be required to indemnify as there is no liability on IPFM part for loss, damage and claims or expenses incurred by the Registered User for incorrect information uploaded in IPFM portal.
  • Registered User accepts to pay the annual subscription as decided from time to time and posted in the IPFM portal. IPFM reserves the right to reject any Registered User from accesing the portal if there is a delay in making subscripting payment beyond thirty days from the due date.
  • Registered User cannot transfer, negotiate and settle their subscription to any third party. Also the Registered User cannot transfer their liabilities under this contract to a third party.
  • IPFM assures an uninterrupted web service to the Registered User however IPFM does not warrant that the functions of the web site will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make it available free of viruses or other harmful components. IPFM liability on account of any defect in the web service will be restricted up to the maximum of the subscription amount for the balance period.
  • IPFM shall not be liable for any failure to perform any of its obligations under these Terms or provide the Services or any part thereof if the performance is prevented, hindered or delayed by a Force Majeure Event (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure Event continues. “Force Majeure Event” means any event due to any cause beyond the reasonable control of any Party, including, without limitation, unavailability of any communication system, breach or virus in the systems, fire, flood, explosion, acts of God, civil commotion, riots, insurrection, war, acts of government.
  • Terms and conditions may be amended from time to time depends on the legal requirement, change in the scope of services and technology developments. Any such amendments shall be intimated in this web portal and the Registered User accepts to such variation in the terms and conditions.
  • The terms and conditions are subject to Indian laws and shall be subject to the jurisdiction of the Courts in Bangalore.
  • The Registered User understood the functioning of the web portal.
  • Representation of the Registered User by a third party shall not be entertained in all routine transactions, upload, update, search and usage of the web portal.
